2. Scope

These Terms of Sale apply to all contracts concluded between ÏMAIMA and customers through our online shop.Our products are primarily offered to consumers for personal, non-commercial use. Individual agreements made with customers take precedence over these Terms of Sale where expressly agreed.

3. Our Products

ÏMAIMA is a Berlin-based slow fashion label. Our pieces are designed in Berlin and crafted in Jaipur, India, using traditional techniques and small-scale production. Many of our garments are handmade or incorporate hand-crafted elements. As a result, slight variations in colour, texture, embroidery, print or finish may occur. These variations are inherent to the craftsmanship and are not considered defects.Product images are provided for illustration. While we make every effort to represent colours and details accurately, the appearance of a product may vary depending on your screen and device.

4. Prices

All prices displayed in our online shop are stated in euros and include applicable statutory VAT, unless expressly stated otherwise.Shipping costs are not included in the product price unless a product or promotion expressly states that shipping is free. Any applicable shipping costs will be clearly displayed during the ordering process before you place your order.Promotional offers and discounts are valid only for the stated period and subject to the conditions communicated with the respective offer.

5. Ordering and Contract Formation

The presentation of products in our online shop does not constitute a legally binding offer. By placing an order through the online shop, you submit a binding offer to purchase the selected products. Before submitting your order, you will have the opportunity to review and correct your order details.The contract is concluded when ÏMAIMA accepts your order by sending an order confirmation by email or otherwise confirms acceptance of your order. If a product is unavailable after your order has been placed, we will inform you as soon as possible and refund any payment already made for the unavailable product. The order confirmation and these Terms of Sale will be made available to you in a form that can be stored and reproduced.

6. Payment

We offer the payment methods displayed during the checkout process.Payment is due at the time of ordering unless another payment arrangement is expressly agreed. All payment information is processed through the respective payment provider. ÏMAIMA does not store complete payment card details.

7. Delivery and Shipping

We deliver to the countries displayed as available during checkout.Available delivery methods, estimated delivery times and shipping costs are displayed during the ordering process.Delivery times may vary depending on the destination, availability of the product and circumstances outside our reasonable control.If a product is temporarily unavailable, we will inform you of the expected delivery time.For international deliveries, additional customs duties, import taxes or other charges may apply depending on the destination country. Unless expressly stated otherwise, such charges are the responsibility of the customer.

8. Returns and Right of Withdrawal

Consumers have a statutory right of withdrawal in accordance with applicable German and European consumer protection law.The statutory withdrawal period is generally 14 days. The withdrawal period and its legal requirements are explained in our separate Withdrawal Policy / Widerrufsbelehrung.Nothing in these Terms of Sale limits or excludes any statutory consumer rights.In addition to the statutory right of withdrawal, any voluntary return policy offered by ÏMAIMA will be clearly stated separately and does not affect your statutory rights.

9. Refunds

Where a customer validly exercises their statutory right of withdrawal, refunds will be processed in accordance with applicable law.We will generally use the same payment method used for the original transaction unless another method has been expressly agreed.We may withhold reimbursement until we have received the returned goods or until the customer provides evidence that the goods have been returned, whichever occurs first, where permitted by law.The customer is responsible for the direct cost of returning goods where this has been communicated in accordance with applicable law and ÏMAIMA has not expressly agreed to bear those costs.

10. Statutory Warranty and Defective Products

ÏMAIMA is responsible for ensuring that products comply with the statutory requirements applicable to consumer purchases.Consumers have the statutory rights relating to defects and conformity of goods under German law. These rights apply independently of any voluntary commercial guarantee that ÏMAIMA may offer. If you receive a product that is defective, damaged or does not correspond to the agreed product, please contact us at info@iimaima.com. We will inform you of the applicable options for remedying the defect in accordance with statutory law. Handmade characteristics, including minor variations in texture, print, embroidery, colour or finish resulting from the production process, are inherent to our products and do not constitute defects where they correspond to the agreed characteristics and quality of the product.

Commercial Guarantees

Unless expressly stated otherwise on the respective product page or in the applicable guarantee terms, ÏMAIMA does not provide a separate commercial guarantee (Garantie) beyond the statutory warranty rights.Where a commercial guarantee is offered for a particular product, the applicable guarantee conditions, duration and scope will be clearly communicated to the customer before purchase. Nothing in these Terms of Sale limits or excludes any statutory consumer rights.

11. Intellectual Property

All content published on the ÏMAIMA website, including photographs, product images, texts, graphics, logos, designs and other visual materials, is protected by copyright and other intellectual property rights. The content may not be reproduced, distributed, modified, published or commercially used without our prior written permission, except where permitted by law.

12. Website Use

The ÏMAIMA website is provided for lawful personal use. Customers must not misuse the website, interfere with its operation, attempt to gain unauthorised access to systems or data, or use the website for fraudulent or unlawful purposes.

13. Liability

We are liable without limitation for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty by ÏMAIMA or our legal representatives or agents. For other damages, our liability is limited to cases of intent and gross negligence, as well as cases in which essential contractual obligations have been breached, subject to the limitations permitted by applicable law. Nothing in these Terms of Sale excludes or limits liability that cannot legally be excluded or limited.

14. Force Majeure

We are not responsible for delays or failure to perform our contractual obligations where these are caused by circumstances beyond our reasonable control, including natural disasters, war, strikes, government restrictions, transport disruptions, pandemics or significant interruptions to supply chains. Where such circumstances affect an order, we will inform the customer as soon as reasonably possible.

15. Privacy

nformation about how we collect, process and protect personal data is provided in our separate Privacy Policy. The processing of personal data is carried out in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR).

16. Governing Law

German law applies to these Terms of Sale, except where mandatory consumer protection provisions of the country in which a consumer has their habitual residence provide otherwise. For consumers, statutory rights regarding the place of jurisdiction remain unaffected.

17. Alternative Dispute Resolution

The European Commission's online dispute resolution platform (ODR platform) was discontinued on 20 July 2025. Any applicable information concerning consumer dispute resolution will be provided in accordance with the law applicable to ÏMAIMA.

18. Changes to These Terms

We may update these Terms of Sale where necessary, for example to reflect changes to our services, legal requirements or business practices. The version applicable to an order is the version in force at the time the order is placed.

19. Severability

If any provision of these Terms of Sale is found to be invalid or unenforceable, the remaining provisions remain unaffected. The applicable statutory provisions will apply in place of the invalid or unenforceable provision.
